RETURN AND REFUND POLICY

RETURN POLICY FOR ORDERS FULFILLED BY LIBERTY SAFE: Thank you for shopping at Liberty Safe. If you are not entirely satisfied with your purchase, we’re here to help. Our products can be returned within 30 days of the original purchase of the product. A new product may be exchanged for another product or returned for a refund.

To be eligible for a return, please make sure that:

The product was purchased in the last 30 days.
The product is in its original packaging.
The product is not used or damaged.  You have the receipt or proof of purchase.
You obtained a Return Merchandise Authorization number (“RMA Number”) from us.

Products that do not meet these criteria will not be considered for return.

To obtain a RMA Number, contact us by phone at 800-247-5625 or by email at returns@libertysafe.com.

Send the product with its original packaging, the receipt or proof of purchase, and the RMA Number, along with a note indicating whether you want to exchange the product (and if so, which product you want in exchange) or receive a refund, to:

Shipping Charges

Shipping charges incurred in connection with the return of a product are non-refundable. You are responsible for the costs of shipping and the risk of loss of or damage to the product during shipping, both to and from Liberty Safe. In the rare case that your product arrives damaged, Liberty Safe will cover the cost of return shipping; however, you must first obtain a RMA Number and a return shipping label from Liberty Safe.

SHIPPING AND DELIVERY POLICY

IN-STOCK AND OUT-OF-STOCK ORDERS. In most cases, your safe (or one similar to it) will be in- stock at your local dealership. If the safe is OUT-OF-STOCK, the dealer will add it to their next shipment at no additional fee (special orders are usually shipped within 6-10 weeks).

CURBSIDE DROP OFF. Curbside drop off is limited to delivery of the safe to the curbside of a residence or business within 25 miles of the dealership (for a distance greater than 25 miles, a per-mile fee is charged for each mile above 25). The safe pallet is not removed during curbside delivery. IN HOME - MAIN FLOOR installation is limited to typical first-floor access involving 0 to 4 outside steps within predetermined local zones. A flat level concrete or paved pathway is required. The customer is responsible for ensuring the pathway, deck, steps, staircase, and foundation are adequate to support the weight of the safe, the safe-transporting equipment, and the installation crew. Certain stairways, marble floors, or other obstacles may involve additional charges. The pallet is removed from the safe during main floor and stair carry deliveries. STAIR CARRY - CUSTOM installation upstairs or downstairs includes 5- 15 additional steps inside the home. Due to size and weight, stair carry is not available on 40 and 50 SIZE MODELS. In some cases, even the 25 and 35 size safes cannot be delivered due to landing space restrictions, staircase structure, and the spacing required for the safe and the stair-climbing equipment attached to the safe. Some dealers can visit the site and review the delivery route before confirming that the safe can be delivered. PLEASE NOTE: DIFFICULT DELIVERIES due to outside terrain, certain types of stairways, second-floor or multiple-floor installations, marble/tile/wood floors, etc. may involve additional charges to complete the delivery. We reserve the right to decline installations and/or delivery involving a risk of personal injury or property damage. Title to the purchased merchandise will transfer to the buyer at the dealer’s location. Delivery charges and options may vary by dealer. If you have any questions regarding delivery requests, please contact your authorized Liberty Safe dealer.

WEBSITE SECURITY

Users are prohibited from violating or attempting to violate the security of the Website, including, without limitation: (a) accessing data not intended for such user or logging onto a server or an account which the user is not authorized to access; (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; (c) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the Website, overloading, flooding, spamming, mailbombing, or crashing; (d) sending unsolicited email, including promotions and/or advertising of products or services; or (e) forging any TCP/IP packet header or any part of the header information in any email or newsgroup posting. Violations of system or network security may result in civil or criminal liability. Liberty Safe will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations. You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of this Website or any activity being conducted on this Website. You agree, further, not to use or attempt to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search this Website other than the search engine and search agents available from Liberty Safe on this Website and other than generally available third party web browsers (e.g., Google Chrome, Microsoft Edge, Mozilla Firefox, Apple Safari).

GENERAL

This Agreement constitutes the complete agreement between the parties and supersedes all prior agreements and representations between them. If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable, and the other terms of this Agreement shall remain in full force and effect. The failure of Liberty Safe to act with respect to a breach of this Agreement by you or others does not constitute a waiver and shall not limit Liberty Safe’s rights with respect to such breach or any subsequent breaches. This Agreement shall be governed by and construed under the laws of the State of Utah, without regard to its conflict of laws principles. Subject to the Dispute Resolution and Arbitration section below, any action or proceeding that is not subject to arbitration under this Agreement must be brought in the state or federal courts located in Utah, and you hereby consent to the exclusive jurisdiction of such courts for such purposes.

USER COMMENTS AND OTHER SUBMISSIONS

All comments, feedback, reviews, ratings, suggestions, ideas, and other submissions disclosed, submitted, or offered to Liberty Safe on or through this Website or otherwise disclosed, submitted, or offered in connection with your use of this Website (collectively, the “Comments”) shall be and remain Liberty Safe’s property. Such disclosure, submission, or offer of any Comments shall constitute an assignment to Liberty Safe of all worldwide rights, titles, and interests in all copyrights and other intellectual property in the Comments. Liberty Safe will own exclusively all such rights, titles, and interests and shall not be limited in any way in its use, commercial or otherwise, including publishing and sharing, of any Comments. Liberty Safe is and shall be under no obligation to: (1) maintain any Comments in confidence; (2) pay any compensation to any user for any Comments; or (3) respond to any user Comments. You agree that no Comments submitted by you to the Website will violate any right of any third party, including copyright, trademark, privacy, or other personal or proprietary right(s). We have made every effort to display as accurately as possible the colors of our products that appear on the Website. However, because the actual colors you see will depend on your computer monitor, lighting, and other factors, we cannot guarantee that any color will be accurate.

INDEMNIFICATION

You agree to defend, indemnify and hold Liberty Safe harmless from and against any and all claims, damages, costs and expenses, including attorneys’ fees, arising from or related to your use of the Website or your breach of any provision of this Agreement.

TERMINATION

This Agreement is effective unless and until terminated by either you or Liberty Safe. You may terminate this Agreement at any time by discontinuing any further use of this Website. Liberty Safe may terminate this Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Website, if in Liberty Safe’s sole discretion you fail to comply with any term or provision of this Agreement. Upon any termination of the Agreement by either you or Liberty Safe, you must promptly destroy all materials downloaded or otherwise obtained from this Website.

THIS WEBSITE IS PROVIDED BY LIBERTY SAFE ON AN “AS IS” AND “AS AVAILABLE” BASIS. LIBERTY SAFE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE WEBSITE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON THIS WEBSITE. DISPUTE RESOLUTION AND ARBITRATION

You and Liberty Safe agree that any dispute, claim, or controversy arising out of or relating to this Agreement, your use of the Website, or any products or services purchased through the Website (collectively, “Disputes”) will be resolved exclusively through final and binding arbitration, rather than in court, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

The arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules then in effect, except as modified by this Agreement. The AAA Rules are available at www.adr.org. The arbitration will be conducted by a single neutral arbitrator. Any arbitration hearing will take place in Salt Lake City, Utah, unless the parties agree otherwise or, if the claim is for $10,000 or less, you may choose whether the arbitration will be conducted solely on the basis of documents, through a telephonic hearing, or by an in-person hearing.

Payment of all filing, administration, and arbitrator fees will be governed by the AAA Rules. If the arbitrator finds that either the substance of your claim or the relief sought is frivolous or brought for an improper purpose, then the allocation of fees will be governed by the AAA Rules, and you agree to reimburse Liberty Safe for all fees associated with the arbitration that it has paid on your behalf.

YOU AND LIBERTY SAFE EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, YOU AND LIBERTY SAFE EACH WAIVE ANY RIGHT TO A JURY TRIAL. This arbitration provision shall survive termination of this Agreement and your use of the Website.

Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

Entire Agreement

The Terms of Use, our Privacy Policy, our Refund Policy, and our Accessibility Statement constitute the sole and entire agreement between you and Liberty Safe regarding the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Website.
